The Role of the Global Legal and Regulatory System in Establishing Trustworthy Behaviour
Overview The purpose of this article is to explore how the Law can be used to give rise to a more trustworthy economic system.The Trustworthiness of those in positions of authority is important.The Global Financial Crisis and related events have demonstrated that market outcomes are not sufficient to ensure trustworthy behaviour.Drawing on findings from Capital Failure: Rebuilding Trust in Financial Services, we discuss what is meant by Trustworthiness, and what needs to be done to ensure it becomes the norm.Then we explore the role that can be played by the Legal System, nationally and globally, to encourage trustworthy behaviour.
