Linguistic Uncertainty and Statutory Interpretation

摘要：

Language is inherently indeterminate．Linguistic uncertainties sometimes lead to legaldisputes and become matters of contention in court．This essay focuses on 1inguisticuncertainty in legislation and discusses the legal implications of such uncertaintywith specific reference to the Chinese and Australian legal contexts，examining theissue from a comparative perspective．It argues that 1 inguistic uncertainty is inherentin language including legal language，and that the judiciary has an important role toplay in providing certainty in cases of 1inguistic and legal uncertainty．
