”THE ROAD To LESS ADVERSARIAL TRIALS AND BEYOND”

摘要：

The Family Court of Australia is the first Austral Jan superior court to apply a lessadversarial trial procedure in civil proceedings．This paper examines that trialprocedure and its success．The benefits include greater access to justice，reduced courttime and legal costs，resulting in a significant improvement in the settlement ofdisputes without a court determination．The importance of this reform iS heighteneddue to financial pressures suffered by citizens，courts and government as a result ofthe impact of the current global financial crisis．As has been recently emphasised by the Australian Attorney-General“”a”n essentialcriterion of an effectire justice system iS the accessibility of all its parts．Withoutthis，the system is compromised and in danger of losing its relevancy to，and respectfrom community it serves．”
