香港集合住宅业主的管理权力

Overwhelming majority of home owners in Hong Kong live in high rise condominiums,many of which are big in scale. For instance,over half of home owners in Hong Kong live in residential projects that have more than 1000 households. Yet,paradoxically,there is no formal legislation which governs the development of multi-owned properties. Setting up of owners’ corporations to exercise flat owners’ collective management rights only began as late as the early 1970. However,less than forty percents of condominiums do have such organizations which enable them to dismiss their incapable management agents. Power distribution between the owners and their management agents is also highly skewed. Owners are often dependent on their management agents,who possess the technical know-how,in managing their big and sophisticated residential properties. Many such management agents are also backed up by their parent companies which are powerful developers. Based on data from documents on relevant legislation and interviews with owner organizations,this paper will employ the “ critical legal events” approach to examine the transfer of power from the developer to condominium owners and the subsequent distribution of power among the parties involved in the management of such projects.
