Integrity Institutions:A Comprehensive Mechanism Imperative for Selection and Empowerment of Constitutional Functionaries
Integrity institutions in India are passing through a period of stress.If political masters did not appreciate an upright Comptroller and Auditor General (CAG) like Mr Vinod Rai, the Supreme Court of India quashing the appointment of Central Vigilance Commissioner (CVC) P.J.Thomas has only strengthened public cynicism, general mistrust and lack of confidence on these institutions.This has adversely affected good governance and become a threat to the worlds largest democracy.The paper seeks to examine Indias integrity institutions—the CAG, the CVC, the Director of the Central Bureau of Investigation, the Chief Election Commissioner and the Central Information Commissioner —in five case studies.It will study the means of ensuring their professional independence including statutory procedures to be followed, means of appointment and tenure and compare how these apply in different countries.Finally, after comparing the international trends with the Indian realities, the author examined the role of the media and civil society and emphasised the imperative need to empower the integrity institutions.
