Consumer Rights and Interests Protection in China:Practice,Problems and Paths to Improve

  In recent years, with the rapid development of Chinas economy, significant improvement of living standards and dramatic changes of both economic and social structures, the topics concerning with consumer fights and interests protection are increasingly becoming the focus of Chinese attention.Based on a comprehensive review on the practice of consumer fights and interests protection in China, the paper finds the following truths.First, since the reform and opening-up in 1978, the cause of Chinas consumer fights and interests protection has made remarkable achievements with distinct Chinese characteristics, this is called administration-orientated mode.Second, despite enacting a series of consumer fights and interests protection laws, administrative and departmental regulations by Chinese Government, the behaviors that infringe the consumer interests have not been effectively controlled yet, which indicates that consumer fights and interests protection laws are not strikingly effective.With a deep analysis on the causes of behaviors violating consumer fights and interests protection laws in China, the paper points out that the effective protection of consumer fights largely depends not only on the perfect construction of legal system, but more on the perfection of social credit system.And then, we put forward the new path to the consumer fights and interests protection, focusing on the construction of social credit system based on the rule of law.
