Study on Relief System of Administrative Contract in China

摘要：

In modern democratic society, the administrative contract, as a new means of administration, plays an important role in the administration of the government. The utilization of administrative contracts has led to a great number of administrative contract disputes. So the relative relief system should be established in order to solve administration contract disputes and better protect the public interest represented by the executive and the legitimate rights and interests of the contract relative. But until now we have not established perfect administration contract system, and the relief system for administrative contract is still imperfect, both of which, to a great extent, hinder the development of Chinas administrative contract system in theory and practice. Therefore, on the basis of analysis of Chinas actual conditions, the paper will explore the status of relief system for administrative contract and give relative suggestions by learning from outstanding achievements of the western countries.
